Terms of Service

1. Acceptance of Terms

By accessing or using the DaycareMS platform, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you do not have permission to access the service.

2. User Accounts

When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our service.

• You are responsible for safeguarding the password and credentials you use to access the service.
• You agree not to disclose your password to any third party.
• You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. Acceptable Use

DaycareMS is specifically designed for the administration and management of daycare facilities, child care centers, and related programs. You agree to use the service only for these intended purposes.

You may not use the service to:

• Violate any local, state, or federal laws regarding child care, data privacy (including COPPA), or financial transactions.
• Store or transmit highly sensitive personal health information (PHI) subject to HIPAA, unless explicitly authorized and contracted to do so.
• Transmit spam, malware, or engage in disruptive technical practices.

4. Payments, Subscriptions, and Refunds

For DaycareMS subscription services, all payments are processed securely. Please note that payments are processed by Shoetinblanks LLC. This name will explicitly appear on your credit card statements, bank statements, and invoice receipts. By providing payment information, you authorize Shoetinblanks LLC to charge the applicable fees to your designated payment method.

Subscription Cancellations and Refunds: You may cancel your DaycareMS subscription at any time. Cancellations will take effect at the end of your current billing cycle, and you will retain full access to your account features until that time. We do not offer prorated refunds, credits, or partial refunds for canceled subscriptions, partial months, or unused time. All subscription payments are final and non-refundable.

5. Limitation of Liability

In no event shall DaycareMS, Shoetinblanks LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the service.
• Any conduct or content of any third party on the service.
• Any disputes, claims, or damages arising between Daycare Providers and Families using the platform.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the service will immediately cease. If you wish to terminate your account, you may simply discontinue using the service or contact us for data deletion as outlined in our Privacy Policy.
